Critical Update: 2027 Deadlines

The 2027 ADA Deadline Explained

There is a lot of confusion between Title II and Title III. We've broken down exactly who needs to be ready and when.

ADA Title II

State & Local Governments

Applies to all public entities, including state and local governments, public schools, universities, and transit agencies.

The 2027 Deadline

Entities with population 50,000+ must be compliant by April 26, 2027.

Technical Standard

Strict adherence to WCAG 2.1 Level AA is now legally mandated.

ADA Title III

Private Businesses

Applies to "places of public accommodation," which includes almost all private businesses that serve the public.

No "Future" Deadline

Unlike Title II, Title III has no specific 2027 deadline because compliance is already required today.

Enforcement Standard

While the DOJ suggests WCAG 2.1 AA, courts are already penalizing businesses for any lack of "effective communication."

The Compliance Roadmap

The Department of Justice has set a clear path. Here is the schedule for Title II entities.

April 2024

Final Rule Published

The DOJ officially adopted WCAG 2.1 Level AA as the technical standard for Title II web content and mobile apps.

April 26, 2027

Deadline: Large Entities

Public entities with a total population of 50,000 or more must have all web content and mobile apps fully compliant.

April 26, 2028

Deadline: Small Entities

Public entities with populations under 50,000 and special district governments must meet the same standards.

Is Your Business Ready?

If you are a private business (Title III), you might think you have until 2027 to breathe. This is a dangerous misconception.

The Title II rule serves as the "Gold Standard." Even though it technically applies to governments, trial lawyers and the DOJ use it as the benchmark for Title III businesses. If your site doesn't meet WCAG 2.1 AA today, you are already at risk of:

Demand Letters
Market Share Loss
SEO Penalties
Poor Brand Image
